Board of Adjustments

The Board of Adjustments hears and decides appeals related to:

  1. Allegations of error in any order, requirement, decision, or determination made by the Building Official in the enforcement of the Zoning Ordinance;
  2. Zoning regulations or interpretation of any map; 
  3. Requests for variances from the strict application of the Zoning Ordinance. 

Meetings

The Board of Adjustments meets on an as-needed basis.

Board of Adjustments Appeal Application

Appeals shall be made to the Board of Adjustment within 30 days of the cause of the appeal through the office of the Building Official in written form as determined by the Building Official. The Board shall fix a reasonable time for the hearing of the appeal and shall decide the appeal within 30 days of the date of the public hearing. An appeal stays all proceedings in furtherance of the action, unless the Building Official certifies to the Board that by reason of the facts stated in the certificate, a stay would, in his/her opinion, cause imminent peril to life or property. In such cases, proceedings shall not be stayed otherwise than by a restraining order which may be granted by the Board of Adjustment or by the District Court on notice to said officer and on due cause shown.
