Know When You Need a Permit

I want to take time to revisit one of our most common questions. “Do I need a permit for (insert project)?”

The answer is more than likely yes. Permits are required for most projects that are adding something new to an existing lot, altering an existing structure on the lot, or demolishing a structure.

Permits are required for a number of reasons:

  1. The structure being built conforms to the adopted building codes and zoning ordinances.
  2. The structure being built meets the required setbacks of the property.
  3. The structure(s) on the property are within the allowed size and number of structures allowed on a property.
  4. Work being done (encroaching) in the city right-of-way is done to the specifications required by the Engineering Department. Encroachment permits are most commonly issued for sidewalk repair or installation, driveways, and fences that extend into the right-of-way.

Our most common permits are for fences, decks, and accessory structures.

Accessory Structures

Beatrice Zoning Ordinance allows up to 2 accessory structures per property, which, when combined, may not exceed 1,200 square feet. A special use permit may be obtained to increase the maximum square footage to 1,800 square feet.

Accessory Structures are defined as:

“A structure which is incidental to and customarily associated with a specific principal use or primary use residence or building on the same lot or site.”

An accessory structure cannot be built on a residential lot that does not contain a primary residence, or a commercial lot that does not have a primary business which is open to the public a minimum of 20 hours per week.

This includes pre-fabricated garden sheds and carports. Yes, carports are considered an accessory structure and are required to have a permit, as well as to meet setbacks.

Fence Permits

Fence permits are required to ensure:

  1. The fence is placed in the correct location.
  2. The fence does not exceed the allowed height.
  3. The fence is constructed of approved materials.
  4. The fence orientation is correct, with the framed side facing the interior and the panel side facing outward.

Before You Start Your Project

Before you start your project, stop by the Community Development office. We can answer any questions you may have about permitting.
